Rhea Chakraborty Gets Relief in Sushant Singh Rajput Case, Court Orders Accounts Defreezed

Rhea Chakraborty has secured relief after a special NDPS court ordered the defreezing of her and her brother Showik Chakraborty’s bank accounts, citing procedural lapses by the Narcotics Control Bureau.

COURT ORDERS ACCOUNTS DEFROZEN

The accounts had been frozen in 2020 during an NCB probe linked to the alleged drug angle in the death of Sushant Singh Rajput.

In its order on Saturday, the court directed that the accounts be defreezed, holding that mandatory legal procedures were not followed.

KEY LEGAL LAPSE FLAGGED

The court pointed to non-compliance with provisions under the NDPS Act. It noted that as per the law, any freezing order must be confirmed by a competent authority within 30 days.

Since no such confirmation was obtained in this case, the court ruled that the action had no legal standing.

DEFENCE ARGUES DUE PROCESS VIOLATION

Rhea and her brother moved the court through their lawyers, arguing that the agency failed to follow due process. They said the absence of timely approval made the freezing of accounts invalid.

PROSECUTION’S STAND REJECTED

The prosecution opposed the plea, citing statements and alleging links to a drug network. It argued that the freezing was justified during the investigation.

However, the court rejected this argument, observing that failure to comply with mandatory legal requirements could not be overlooked.

BACKGROUND

Rhea Chakraborty was arrested in September 2020 on drug-related charges linked to the case. She was accused of procuring drugs for Rajput and spent 28 days in custody before being granted bail.
