SC Rejects Justice Yashwant Varma’s Plea Against Removal Recommendation.
The Supreme Court on Thursday dismissed the plea filed by Justice Yashwant Varma challenging an in-house inquiry committee report that had recommended his removal after a large stash of cash was recovered from his residence earlier this year.
With this verdict, Parliament is now free to proceed with impeachment action against the judge, who had also contested the former Chief Justice of India’s recommendation to the President seeking his dismissal.
A bench comprising Justices Dipankar Datta and A.G. Masih upheld the validity of the in-house committee’s formation and its procedures, ruling that there were no legal irregularities in the inquiry.
“The Chief Justice of India and the in-house committee strictly followed the due process, except for uploading photographs and videos — which we found was not necessary in this case,” the bench observed. “Moreover, you did not object to it at the time.”
The Supreme Court further stated that the CJI’s communication to the Prime Minister and the President recommending Justice Varma’s removal was not unconstitutional. “We have left certain issues open, allowing you the option to raise them in future proceedings, if required,” the bench noted.
